New regulations on recruiting foreignemployees shall come into force from 01/11/2013, Nhi Gia would like to inform enterprises of changes asfollows:

5 CONDITIONS FOR LICENSING FOREIGN EMPLOYEES

The Government has issued a Decree detailing the implementation of a number of articles of the Labor Code on employment of foreign workers in Vietnam. Accordingly, The Decree specifies five conditions for foreign employees to obtain work permits.

 

Five conditions for licensing foreign employees include:

1. To have full civil act capacity in accordance with present Laws.  
2. To be physically capable of working.
3. To be managers, executives, experts or technical workers.

For foreign people who practice medical examination and treatment in Vietnam or work in the fields of education and vocational training, they must meet the conditions prescribed by the Vietnamese law.

1. Not to be crimes or subject to criminal liabilities prescribed by the Vietnamese law and foreign Law.
2. To have approval in writing from competent State agencies for recruiting foreign employees.

The maximum validity duration of a work permit is two years. However, validity duration of work permits may vary, depending on:

• Term of the contract to be signed
• Time limit set by foreign entities which appoint foreign workers to work in Vietnam
• Term of the contract or the agreement signed between Vietnamese and foreign partners

=> According to new regulations, enterprises having the demand for overseas labours must be approved in writing for recruiting foreign workers for any specific positions by Chairman of People’s Committee where employers are headquartered.
